Terms & Conditions

This contract is between (1) FIRST SCAN HEALTH LIMITED (“FSH”); (2) The limited company who operates the clinic that you attend, trading as firstScan Health (“we” “us”) and (3) you, the customer (“you”) and shall be governed by the following terms and conditions of sale (“Conditions”), none of which affect your statutory rights:

  1. The Services. We provide diagnostic health scans. Our scans are completed by trained and registered medical professionals specialising in diagnostic ultrasound. They may be radiographers, midwives, or doctors (in these Conditions referred to as sonographer(s)). With your consent, we will carry out a diagnostic ultrasound scan. The primary purpose of the scan is to assess your health and well-being. Your scan will consider various parameters relevant to your condition, and in the event that your sonographer identifies any areas of concern, they will discuss their findings with you. If necessary, we may offer treatment at the clinic or refer you to your NHS care provider for ongoing care. With your permission, we will send a copy of the Report to your NHS care provider. It is your responsibility to ensure you then consult with your NHS care provider.

  2. Medical history. You understand and accept that we do not have your complete medical history and, therefore, cannot provide general medical advice outside the scope of the diagnostic ultrasound performed. We will openly discuss any diagnosis resulting from the ultrasound findings during your appointment and advise you on available treatments either locally or from your NHS care provider. It is imperative that you access all relevant services offered by the NHS as they may offer additional care services not provided by firstScan Health. You understand that any scan is not a substitute for comprehensive medical diagnostic assessments and may not detect all conditions due to the limitations of ultrasound. A copy of our policy on diagnostic limitations is available on request at each clinic.

  3. Method. We aim to complete your scan using an abdominal approach, but in certain cases, we may need to undertake an internal (Trans Vaginal) scan. Your sonographer will discuss this with you beforehand. We will ensure your dignity is respected, and a trained female chaperone is provided for all scans. You can decline an internal scan, but if you do, you accept that we may not be able to provide conclusive information.

  4. Modification. We reserve the right to modify or improve our services without prior notice.

  5. Photography & recording. We do not allow personal photography to be carried out in our clinics.

  6. Age. You must be 18 years old or over; if you are 16 or 17 years old, a responsible adult acting in the capacity of a guardian must accompany you to your appointment. We cannot scan anyone under the age of 16.

  7. Right to make changes. If you wish to make a change to the services or products you have ordered, please contact us. We will let you know whether the change is possible.

  8. Prices. Our prices will be set out in our price list. We accept payment by debit or credit cards, but not American Express. We also accept payment by cash at the clinic.

  9. How we accept your order. Our acceptance of your order will take place when you make a payment of the deposit of £30.00. If we are unable to accept your order, we will inform you in writing and will not charge you. This might be due to unexpected limits on our resources.

  10. Information we require in order to provide the services. We will need certain information from you in order to provide the services (for example, relevant health information and medical history). If you do not provide us with this information or provide incorrect or incomplete information, we may either end the contract or charge a reasonable sum for additional work required to obtain the correct information. We will not be responsible for any delays in supplying the services if you do not provide the necessary information.

  11. Cancellation of the services by you. You can always end the contract for the supply of services before you have received the services, but you may not be entitled to a refund if you cancel after the services have been provided. If the product is faulty, you may be entitled to a refund. See the “Your Rights” box for more information.

  12. Cancellation of the services by us. We may suspend or cancel the services if you do not pay when required or fail to provide the necessary information. We will refund any money you have paid in advance if we have not provided the services, but may deduct reasonable costs incurred.

  13. What you will receive following the scan. You will receive a scan report of findings following your ultrasound scan.

  14. Ownership of the product. We retain copyright of any images we take. Ownership of the Report shall belong to you once we receive payment in full for the services.

  15. What we cannot guarantee. We undertake to provide you with the best possible images, but you understand that certain factors, such as the position of organs or other factors during the scan, are beyond our control. We will make every effort to ensure your appointment runs on time.

  16. Our Liability to You. We are not responsible for any injury, loss, or damage to personal belongings while you are on our premises. We are only liable for our failure to comply with these Conditions, and accept responsibility for foreseeable loss or damage caused by our actions. We are not liable for any loss or damage that is not foreseeable or not caused by our failure to comply with the contract. We do not exclude or limit our liability to you where it would be unlawful to do so.

  17. FSH. FSH owns the intellectual property used in promoting our services and manages the website and booking system. FSH is party to this agreement for this purpose only. FSH shall have no liability for any failure to comply with any condition apart from this (17).

  18. Delays outside our control. If we must delay or reschedule your appointment due to an event outside our control, we will contact you as soon as possible and take steps to minimize the delay. We will not be liable for delays caused by such events. If there is a substantial delay, you may contact us to end the contract and receive a refund for services not yet received.

  19. How we use your data. We will use your personal information to provide the services, process payments, and for identification purposes within the organization. We will not disclose your information to external sources without your express consent unless required by law. We will retain copies of your scan for 30 days to resolve any issues you may have following the scan.

  20. Enforceability. If a court finds part of this contract illegal, the rest will continue in force. Each paragraph of these Conditions operates separately.
